Total Disability
If a workplace injury results in the inability to return to work in any capacity, that injury will be considered a total disability injury. There are two important points to make regarding total disability:
- If the disability is total, the workers' compensation benefits continue for life, including all medical treatment.
- Should the worker die as a result of the work-related injury, the spouse and children are entitled to receive benefits.

Second Injury Fund
In New Jersey, if a prior disability combines with a current work related injury resulting in total disability, the Second Injury Fund will pay a certain percentage of the benefits through the remainder of a worker's life. In these situations, you will need an attorney capable of working with the insurance company and the court to properly apportion the prior disability and the most recent work related injury. To qualify for the Second Injury Fund, there are at least two conditions that must be met:
- There must be a new, current work related injury.
- That new injury combines with a prior injury (work related or not) to cause permanent and total disability.
