Helping Workers With Total Disability Move On With Their Lives
If you or a family member has suffered an injury at work, you might be able to receive workers’ compensation benefits. As an attorney with experience representing totally disabled New Brunswick clients, I can help.
I am attorney John D. Kovac, and I have guided hundreds of clients through the process of filing workers’ compensation claims. If an employer or employer’s insurance company challenges or denies the claim, I am comfortable negotiating on my clients’ behalf or representing them in court if necessary.
If a workplace injury results in the inability to return to work in any capacity, that injury will be considered a total disability injury. There are two important points regarding total disability:
- If the disability is total, the workers’ compensation benefits continue for life, including all medical treatment.
- Should the worker die as a result of the work-related injury, the spouse and children are entitled to receive benefits.
To learn more about any aspect of total disability benefits or workers’ compensation, do not hesitate to contact a lawyer at my office for a free initial consultation.
Second Injury Fund
In New Jersey, if a prior disability combined with a current work-related injury results in total disability, the Second Injury Fund will pay a certain percentage of benefits through the remainder of a worker’s life. In these situations, you will need an attorney capable of working with the insurance company and the court to properly apportion the prior disability and the most recent work-related injury. To qualify for the Second Injury Fund, at least two conditions must be met:
- There must be a new, current work-related injury.
- That new injury must combine with a prior injury (work-related or not) to cause permanent and total disability.
